RESOLUTION AUTHORIZING HON. JERWIN S. DIMAPILIS, MUNICIPAL MAYOR TO NEGOTIATE WITH MS. MARIA CRISTINA C. ANDRADE FOR THE ACQUISITION OF A 273-SQUARE METER PARCEL OF LAND LOCATED AT BARANGAY SAN RAFAEL, ROXAS, ORIENTAL MINDORO, COVERED BY ORIGINAL CERTIFICATE OF TITLE NO. 064-2023000108, TO BE UTILIZED AS THE SITE FOR THE BARANGAY SAN RAFAEL PUBLIC MARKET

WHEREAS, Section 16 of Republic Act No. 7160, otherwise known as the Local Government Code of 1991 provides that the local government units shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare;

WHEREAS, the Municipality of Roxas, Oriental Mindoro, prioritizes local economic development and aims to provide accessible trading hubs to enhance the livelihoods of its constituents;

WHEREAS, there is a need to acquire a suitable parcel of land for the establishment of the Barangay San Rafael Public Market, which will serve as a centralized location for trade and commerce, benefiting the local community;

WHEREAS, a specific parcel of land measuring 273 square meters, located at Barangay San Rafael, Roxas, Oriental Mindoro, and registered under the name of Ms. Maria Cristina C. Andrade under Original Certificate of Title (OCT) No. 064-2023000108, has been identified as an ideal and strategic site for the proposed Barangay San Rafael Public Market;

WHEREAS, the Sangguniang Bayan deems it necessary and beneficial to grant the Municipal Mayor the authority to initiate formal negotiations for the acquisition of the aforementioned property, subject to existing laws, rules, and regulations;

NOW THEREFORE, on motion of Councilor Christopher Y. Carvajal duly seconded by Councilor King Philip B. Dimapilis –

BE IT RESOLVED, AS IT IS HEREBY RESOLVED, to authorize the Municipal Mayor, Honorable Jerwin S. Dimapilis, to negotiate with Ms. Maria Cristina C. Andrade for the acquisition of a 273-square meter parcel of land located at Barangay San Rafael, Roxas, Oriental Mindoro, covered by Original Certificate of Title No. 064-2023000108, to be utilized as the site for the Barangay San Rafael Public Market.

RESOLVED FURTHER, that copies of this Resolution be forwarded to the Honorable Jerwin S. Dimapilis, Municipal Mayor, Ms. Maria Cristina C. Andrade, the Barangay Council of San Rafael, and all other offices concerned for their information and guidance.
