RESOLUTION AUTHORIZING HON. JERWIN S. DIMAPILIS, MUNICIPAL MAYOR, AND HIS DULY AUTHORIZED REPRESENTATIVE TO FORMALLY REQUEST THE COMMISSION ON ELECTIONS (COMELEC) TO GRANT AN EXEMPTION FROM THE PROHIBITION UNDER COMELEC RESOLUTION NO. 11265 TO THE MUNICIPAL GOVERNMENT OF ROXAS, ORIENTAL MINDORO, FOR THE RELEASE, DISBURSEMENT, AND EXPENDITURE COVERING QUALIFIED PUBLIC WORKS PROJECTS OF THE MUNICIPAL GOVERNMENT OF ROXAS

WHEREAS, the Commission on Elections (COMELEC) issued Resolution No. 11265 prescribing the rules and regulations on the prohibition on the release, disbursement, and expenditure of public funds in connection with the upcoming elections, subject to such exceptions as may be allowed by the COMELEC under applicable laws, rules, and regulations;

WHEREAS, certain programs, projects, and activities of the Municipal Government of Roxas involving public works are necessary and essential to address the immediate and continuing needs of the residents of the Municipality and to ensure the uninterrupted delivery of basic and essential government services;

WHEREAS, that the requested exemption shall cover only such projects, programs, activities, releases, disbursements, and expenditures as may be qualified under applicable laws, rules, regulations, and COMELEC issuances, and shall be subject to the approval and conditions that may be imposed by the COMELEC;

WHEREAS, that Hon. Jerwin S. Dimapilis, Municipal Mayor, or his duly authorized representative, is hereby authorized to sign, execute, submit, and receive such letters, applications, certifications, undertakings, supporting documents, and other pertinent papers as may be necessary or required by the COMELEC in connection with the said request for exemption;

WHEREAS, the Sangguniang Bayan, after due deliberation, finds the request to be necessary and in the best interest of the Municipality and its constituents;

NOW THEREFORE on motion of Councilor Christopher Y. Carvajal seconded by Councilor King Philip B. Dimapilis -

BE IT RESOLVED to authorize as it hereby authorizes Hon. Jerwin S. Dimapilis, Municipal Mayor of Roxas, Oriental Mindoro, and his duly authorized representative, to formally request, file, submit, and pursue with the Commission On Elections (COMELEC) the necessary application/request for exemption from the prohibition under COMELEC Resolution No. 11265, covering the release, disbursement, and expenditure for qualified public works projects of the Municipal Government of Roxas, Oriental Mindoro.

RESOLVED FURTHER, that copies of this Resolution be furnished to the Commission on Elections (COMELEC) and other concerned government offices for their information, consideration, and appropriate action.
