RESOLUTION AUTHORIZING THE MUNICIPAL MAYOR, HON. JERWIN S. DIMAPILIS, TO NEGOTIATE WITH THE OWNER/S OF THE FORMER ROXAS COLLEGE SCHOOL SITE AND TO MAKE A FORMAL OFFER TO PURCHASE THE SUBJECT PROPERTY FOR THE ESTABLISHMENT OF A PUBLIC TRANSPORT HUB IN THE MUNICIPALITY OF ROXAS, ORIENTAL MINDORO

WHEREAS, the Municipality of Roxas serves as a major commercial and transit hub in the southern region of Oriental Mindoro, experiencing continuous economic growth and an increasing volume of public and private transport;

WHEREAS, the establishment of an organized, modern, and centralized Public Transport Hub is essential to address traffic congestion, streamline local public conveyances, ensure public safety, and spur local economic activity;

WHEREAS, the property formerly occupied by the Roxas College has been identified as a strategic and ideal location for the proposed Public Transport Hub due to its size, accessibility, and proximity to major thoroughfares;

WHEREAS, pursuant to the provisions of Republic Act No. 7160, otherwise known as the Local Government Code of 1991, Local Government Units are empowered to acquire real property for public use or purpose through purchase and negotiation;

WHEREAS, Section 444 (b)(1)(vi) of the same Code mandates that the Municipal Mayor, upon prior authorization by the Sangguniang Bayan, shall represent the Municipality in all its business transactions and sign on its behalf all contracts and obligations;

NOW THEREFORE, on motion of Councilor Christopher Y. Carvajal duly seconded by Councilor Marietta R. Pajila and Councilor David D. De La Cruz –

BE IT RESOLVED, as it is hereby resolved, to authorize Hon. Jerwin S. Dimapilis, Municipal Mayor, to negotiate with the legitimate owner/s or authorized representatives of the former Roxas College school site and to make a formal offer to purchase the subject property for the establishment of a Public Transport Hub in the Municipality of Roxas, Oriental Mindoro.

RESOLVED FURTHER, that the purchase price and final terms of acquisition resulting from the negotiations shall be subject to the review and final approval of the Sangguniang Bayan before execution of the Deed of Absolute Sale.

RESOLVED FINALLY, that copies of this Resolution be furnished to Hon. Jerwin S. Dimapilis, Municipal Mayor, the Municipal Planning and Development Coordinator (MPDC), the Municipal Assessor, the Municipal Legal Officer, and the owner/s of the subject property for their information and appropriate action.
