RESOLUTION AUTHORIZING THE LOCAL CHIEF EXECUTIVE, HON. JERWIN S. DIMAPILIS TO SIGN AND ENTER INTO LOAN AGREEMENT WITH LANDBANK OF THE PHILIPPINES LENDING CENTER FOR AND IN BEHALF OF THE LOCAL GOVERNMENT UNIT OF ROXAS, ORIENTAL MINDORO IN THE TOTAL AMOUNT OF P345,000,000.00 TO FUND THE FOLLOWING: 1. P300,000,000.00 ACQUISITION OF LOT IN BARANGAY BAGUMBAYAN (FORMER SITE OF ROXAS COLLEGE) THROUGH EXPROPRIATION 2. P25,000,000.00 PROCUREMENT OF A DEDICATED BACKHOE/PAYLOADER 3. P20,000,000.00 CONSTRUCTION OF AN ACCESS ROAD CONNECTING THE ROXAS COMMERCIAL COMPLEX TO THE COASTAL/BY-PASS ROAD SUBJECT TO NET BORROWING CAPACITY AND FINAL RATIFICATION OF THE TERMS AND CONDITIONS OF THE LOAN AGREEMENT WITH THE LANDBANK OF THE PHILIPPINES LENDING CENTER BY THE HONORABLE MEMBERS OF THE SANGGUNIANG BAYAN THEREAFTER

WHEREAS, pursuant to Section 444, paragraph (b), sub paragraph 1, item (vi), the Local Chief Executive upon authorization by the Sangguniang Bayan, represents the municipality in all its business transactions and sign on its behalf all bonds, contracts and obligations and such other documents made pursuant to law or ordinance;

WHEREAS, Section 17(3) of the Local Government Code mandates the LGU to exercise power and discharge such other functions and responsibilities as necessary, appropriate or incidental to efficient and effective governance such as providing their constituents the basic services and facilities;

WHEREAS, the Local Government of Roxas does not have sufficient fund to finance the Acquisition of Lot in Barangay Bagumbayan (Former Site of Roxas College) through Expropriation, Procurement of a dedicated backhoe/payloader, and Construction of an access road connecting the Roxas Commercial Complex to the coastal/by-pass road;

WHEREAS, the Landbank of the Philippines, a government financial institution and official depository of government funds, has the capacity to provide credit assistance to the Municipal Government Unit of Roxas;

WHEREAS, the Local Chief Executive, Hon. Jerwin S. Dimapilis, has requested for the authority to enter into a loan agreement with Landbank for the purpose of funding priority projects of the Local Government Unit of Roxas;

WHEREAS, the Sangguniang Bayan of Roxas recognizes the need to authorize the Local Chief Executive to borrow funds and enter into a loan agreement with Landbank of the Philippines Lending Center;

WHEREAS, this body finds the said request to be of merit.

NOW THEREFORE, on motion of Councilor Christopher Y. Carvajal and on mass sponsorship –

BE IT RESOLVED to grant as it hereby grants authority to Honorable Jerwin S. Dimapilis, Municipal Mayor to sign and enter into loan agreement with Landbank of the Philippines Lending Center for and in behalf of the Local Government of Roxas, Oriental Mindoro in the amount of Three Hundred Forty Five Million Pesos (P345,000,000.00) to fund the Acquisition of Lot in Barangay Bagumbayan (Former Site of Roxas College) through Expropriation, Procurement of a dedicated backhoe/payloader, and Construction of an access road connecting the Roxas Commercial Complex to the coastal/by-pass road.

RESOLVED FURTHER, that copies of this resolution be furnished that Landbank of the Philippines Lending Center and the Office of the Municipal Mayor, Office of the Municipal Budget Office, Office of the Municipal Treasurer, Office of the Municipal Planning & Development Coordinator and Office of the Municipal Accountant, and other concerned offices for their information and guidance.
